Many of the types of questions Realtors get from buyers have to do with Zoning ordinances. Some common examples are:


“CAN I PUT UP A FENCE?”

“CAN I BUILD A GARAGE?”

“WHAT SIZE EGRESS WINDOW DO I NEED TO PUT IN?”

“WHERE ARE THE LOT LINES?”

“CAN I ADD ON TO THE HOUSE?”

THE 3 REASONS WHY REALTORS DON’T (AND SHOULDN’T) ANSWER ZONING QUESTIONS DIRECTLY:

1) There is no way for a real estate agents to keep up with all the various changing rules. Each county, city, town, village, township etc have their own zoning rules. In our area for example, there are dozens of local governments, and these rules change from year to year.

2) We can be wrong. in our line of work, answering a question wrong can cost clients big. Let’s say you ask me if you can put up a fence around a house on a busy street and you have 3 small children and 3 large dogs. Being able to put up a fence may be one of the top reasons for buying a particular house. Maybe I see the neighbors have a fence so assume you can too. In this case, I better be absolutely sure I give the correct answer. But if the rules have changed and the neighbors are grandfathered in, that will be something that will drastically change the value to you. Much better for you if I put you directly in touch with the source.

3) We can be held liable. If the government gives you or I incorrect information, they’ll shrug it off no matter how much damage results. But, if they give me incorrect information and I pass it along to you, I may have to fix the damage. Liability increases commissions industry wide. This is why I can’t call them for you. I would love to as an extra service, but the best I can do is put you in touch with them.

Good agents will certainly direct you to the appropriate resource to answer any important question they don’t know the answers to. For zoning type questions, the County Zoning departments are your best resource for up to date information.
